What claims are put through small claims track?

A
  • contract and tort up to £10,000
  • personal injury from road traffic accidents up to £5,000
  • other personal injury up to £1,500
  • Heard by District Judge in County Court
  • usually in private
  • represent themselves, cannot claim cost of lawyer from other side
  • 2-3 hours, limited witnesses

What claims are put through fast track!

A
  • claims up to £25,000
  • heard by circuit judge in county court
  • once it is set down for hearing usually takes 50 weeks
  • more formal, allocated in one day and no. Expert witness restricted
  • pre trial matters given timetable

What claims are put through intermediate track?

A
  • claims between £25,000-£100,000
  • triable I’m up to 3 days
  • 2 or fewer expert witnesses per side
  • complex cases must be allocated to multi track e.g. human rights, against police
  • heard by circuit judge in county court

What cases are put through multi track?

A
  • cases over £100,000 heard by High Court Judge (£50,000 personal injury)
  • complex cases over £25,000 given to Circuit Judge in County Court or High Court Judge in High Court
