What is a tort?
when a party harms another and there is no contract, can be physical, mental, or economic
What are the different terms of tort?
tortious, tortfeasor, and damages
What is tortious?
behavior that constitutes a tort
What is a tortfeasor?
person who commits the tort
What are tort damages?
the injury or monetary loss caused by tort
What is assault?
threatening someone’s physical safety, physical contact is not required, fear must be immediate
What is battery?
unwanted touching of another, touching can be direct or indirect
What is invasion of privacy?
intruding into another’s private affairs
What is false imprisonment?
restraining another against their will without legal authority or justification
What is trespassing?
entering on to another’s land without consent or remaining on another’s land after being asked to leave
What is conversion?
stealing another’s personal property
What is defamation?
publicizing untrue statements about another that harm their character or reputation
What is slander?
spoken defamatory statements
What is Libel?
written defamatory statements
When is the press not liable?
negligently publishes false statements
What is malice?
publishing statements knowing the statements are false
What are public figures?
those who have consciously brought themselves to public, usually cannot sue for defamation
