A

A

Repair : where property requires repair, damages are awarded to cover the cost of repair

What are the definitions of loss of faculty and loss of amenity and what are the awards for them ?

A

Loss of Faculty: means the loss of limbs/body parts or the loss of the ability to use it

Loss of Amenity: Loss of the chance to enjoy activities that are no longer possible due to loss of faculty

Courts use guidelines for this but also depends on interest and backgrounds of claimant

A

Loss of earnings can be split into ‘loss to date’ and ‘future loss’

Loss of earnings could be general or special damages depending on the persons job (salary, self-employed or paid on commission) and how long they’ll be off work for

A

An injunction is an order of the court to stop doing something and if the person on whom the injunction is placed fails to follow the terms of it, he will either be fined or imprisoned for max of 2years.

e.g. banning an activity outright or within certain hours
