Answer 1

To establish a prima facie case for negligence, a plaintiff must prove
(1) that the defendant owed him a duty to conform to a specific standard of care,
(2) that the defendant breached that duty,
(3) that the defendant’s conduct was both the actual and proximate cause of plaintiff’s injuries, and
(4) that the plaintiff sustained actual damages or loss.
