How are things divided in roman law?
Corporeal and incorporeal
Heritable and moveable.
What are corporeal things ?
If it has a physical presence, if it is tangible
e.g land, buildings, goods in a shop
What are incorporeal things?
opposite of corporeal - no physical presence
e.g gas. electricity, rights (both personal and real)
Explain heritable
immoveable
essentially the law of land, as land doesn’t move
Explain moveable
the law of not land and it generally moves
i.e. money, a book, a car etc.
What is corporeal heritable property?
Land and things which form part of the land - naturally i.e soil or by accession, buildings
What is corporeal moveable property?
all other corporeal property that is not land
i.e. goods
What is incorporeal heritable property?
Rights.
Connected with corporeal heritable property e.g lease, contract
or not connected with corporeal heritable property
e.g
Titles and coats of arms
Rights which have a tract of future time
What is incorporeal moveable property?
All other incorporeal property
E.g a patent, copyright, shares in a company
Explain patrimony
the totality of a person’s rights and obligations or assets and liabilities – all the things you own together with all the things you owe
