What is policy of FHP as outlined in THI policy 1.01.03?
Members will conduct THI investigations according to F.S.S 321
THI Investigations shall be conducted by FHP to determine if a criminal violation of F.S.S has occurred. All death investigations shall be conducted as death investigations.
What are objectives as outlined in THI policy 1.01.04 ?
A) To establish guidelines and priorities for members in determining the types of cases to be initiated.
B.) To establish primary areas of investigative responsibility
C.) To implement measures which shall ensure that members are proficient with their duties and procedures in the area of Traffic Homicide Investigations and other death investigations.
When shall a THI Investigation or Death Investigation be conducted? (THI Policy 1.01.05)
1.) An intentional or criminal act is committed that results in a death on roadways or areas within FHP jurisdiction.
2.) A member of the Division investigates a traffic crash involving a death.
3.) If the death occurs 90 days or less from the date of the crash and M.E has determined the death is a result of the traffic crash, THI shall be completed.
4.) If death is more than 90 days from crash, a death investigation will be completed is M.E determines death is result of crash.
a.) THI supervisor shall confer with State Attorney Office to determine is crash is prosecutable
b.) Long form coded as a Non-Traffic Fatality
5.) An unborn child dies in crash and M.E completes death certificate for unborn child.
6.) Non-Fatal crash involving FHP vehicle or on-duty personnel, unless waved by Troop Commander.
7.) Private property crash involving death.
8.) Industrial Crash on or off roadway involving fatality.
9.) Agriculture crash in groves or fields resulting in death.
10.) Fatal crashes, natural deaths, suicides or other incidents involving death on roadways or areas of FHP jurisdiction.

Minimum of two members on scene of every fatal crash. For class 1 or Class 2, one member shall conduct crash investigation and a THI investigator conducts THI. Single vehicle single occupant conducted by THI Investigator.

Team is encouraged and team concept shall be at discretion of THI Sergeant, TWS, or on scene supervisor. Crash investigator shall conduct Next of Kin unless THI investigator elects to conduct themselves.

Investigators are to preserve scene and evidentiary value. Scene is considered a crime scene and crime scene tape should be used. Access of non-essential personnel prohibited.

All physical evidence shall be documented with all its locations documented with photographs using measurements and zero points and reference line, photogrammetry, and other technology. Field Note Packet used to document all evidence. If data table exists, printed copy is sufficient.
Documentation of evidence shall be sufficient to reconstruct crash and include information to create a scale diagram.
Scale diagram should include motion of vehicles and other parties at pre-crash, at-crash, and post-crash.

All pertinent driver information and identification shall be obtained and documented. Sobriety will always be documented. Driver Impairment procedures of section C of THI Chapter 1shall be followed.

All witness information, including public service personnel shall be identified and be interviewed if they can contribute relevant investigative facts.

Names of all law enforcement officers and public personnel shall be obtained. If Division member has significant role, member shall complete digital recorded statement, Witness Statement or incident report.

All news media personnel on scene shall be identified.

All evidence from roadway shall be photographed and documented. Items include:
a.) final rest of vehicles and occupants or pedestrians, including path of travel to final rest.
b.) area of pre-collision approach for each driver
c.) area of initial collision and secondary collisions.
d.) All evidence prior to removal from its resting position.
e.) Scene photos of al involved drivers if possible.
f.) Relevant signs, signals, or marking on roadway.
g.) Confirmation of proper function of traffic control device.
h.) Seatbelts and other occupant restraints.
i.) Evident driver distractions.
j.) Damage to all vehicles, paint transfer, and pattern injuries to occupants.
k.) Driver and occupants not possessing photo identification.
l.) Thorough scene photographs after the scene has been processed and cleared to pre-crash state.

Photographs taken by persons other than THI area to be supplemented and do not replace investigator’s photographs.

All photos forwarded to Department Photo Lab, Neil Kirkman Building with Photo Data Sheet in a timely manner.
a.) all photographic data requested on data envelope shall be completed.
b.) Investigator shall maintain copy of all digital photographs on CD in their field notes.

THI Inv. shall review all FHP photos available and videos taken by persons other than FHP. Copy of all photos be filed with orig. invest. at FHP station.

Photos and fingerprints of deceased shall be taken in every THI inv. unless M.E completes these documents.
a.) FBI fingerprint card shall be used and forwarded to CJIS/FDLE in Tallahasse.
b.) If M.E pers. obtain fingerprints, ensure they are forwarded to FDLE.
c.) RAPID ID can be used to assist identification but does not substitute for section a or b.

Post Crash Inspection of mechanical systems and eval of crash damage to each vehicle shall be conducted.
a.) Document and photograph damage including equip. or mech. failures.
b.) If Event Data Recorder (EDR) is going to be evaluated, obtain search warrant from Circuit Court in criminal cases. If imaged, all other vehicles EDR should be imaged if possible.
c.) If consent is given for EDR, use Consent of EDR Data Form (HSMV 62674)
d.) If independent mechanic is used for inspection, eliminate any real or perceived conflict of interest.
e.) Under no circumstances shall a mechanic who has pers. or prof. associations with driver, occupant, attorney, or insurance comp. be used for post crash inspection.
f.) Source for each area of contact for each vehicle should be identified, including matching damage.
1.) Longitude, lateral, and vertical measurements shall be documented to located area of the vehicles.
2.) Damage analysis should describe impact match points and contain general description of primary direction of force acting on the vehicle. support with photographs.
3.) Sketch or computer generated diagram of vehicles shall be used to document measurements of damage.
4.)Linear perimeter documentation shall be obtained of all involved vehicles of criminal investigations and if applicable, advanced reconstruction shall be applied.

THI Supervisor, scene supervisor, or assigned Inv. shall determine if assistance of support agency is needed on scene. Examples include:
a.) State Attorney’s Office
b.) Medical Examiner.
c.) National Transportation Safety Board and State Warning Point.
d.) Department of Enviromental Protection, Bureau of Emergency Response if hazardous materials are involved.

If commercial motor vehicle, private, public, or non-public transportation vehicle is involved in crash, on scene THI Inv. or supervisor shall notify appropriate Regional Communications Center and have CVE member respond to scene to assist with examination of Driver
a.) Examination shall include but not limited to
(1) drivers license and driver qualification.
(2) Commerical Driver Physical Qualification Certification.
(3) Driver record of duty status, as required.
(4) Hours of service to be confirmed by documentation and comprehensive inspec./investigation.
(5) Complete CVE inspection of Vehicle documenting mechanical safety. When necessary, adv. reconst. techniques be obtained and documented.
b.) CVE member shall obtain all records and reports from the carrier as needed to satisfy investigation. CVE member shall complete all THI related reports/Field Note Packet relating to CMV.
