Theories and Burdens of Proof Flashcards
Who has the evidentiary burden?
Whoever is bringing the claim -> if there is a defence to a criminal offence
The question is whether there is SUFFICIENT evidence to move forward
In a criminal trial where is the evidence assessed for its sufficiency?

The purpose of a trial is to CHALLENGE the sufficiency of the Crowns evidence
The only conclusion you need for me to exist is whether in such a case the evidence is true
Direct evidence

Circumstantial evidence
R v Arcuri
“Is there some evidence on all the essential elements of the offence so that a jury properly instructed and acting reasonably could convict?” What legal test am I?

There must be a weighing of evidence if this kind of evidence exists
