What is section 1 of theft (the definition of theft)
A person who DISHONESTLY, APPROPRIATES,PROPERTY, BELONGING TO ANOTHER with the INTENTION TO PERMANENTLY DEPRIVE
Taking something is not dishonest if…
The person believes they had the right to take
They believed the owner would have consent
The owner couldn’t be found by making reasonable steps
What is bilking? (section 3 Theft Act)
Dishonestly making off without paying as required/expected. Fueling your car and driving off
What is robbery? (Section 8 theft act)
If the offender steals with the use of force or causes FEAR THERE/THEN
- Must steal
- threat needs to be made immediately before or at the time of theft
- They must intent to steal from the outset
What is burglary (section 9.1A)?
When the offender enters the building with the intent to steal, inflict GBH or cause damage to property
Enters = person, instrument or innocent agent
What is Burglary (9.1B)?
Having entered a building as a trespasser, not intending to commit crime.. but your mens rea changes once in the property
What is an activated burglary? (section 10)
When someone commits a burglary with:
W-weapon of offence
I - imitation firearm
F - firearm
E - explosive
