THEFT ACT
‘Going equipped definition’
A person person shall be guilty of an offence who:
- when not at their place of abode
- has with them
- any article
- for the use in the course or in connection
- with any burglary or theft

ROBBERY definition
A person commits robbery:
- Steals
- immediately before or at the time of doing so
- in order to do so
- uses force on any person
- or puts\seeks to put person in fear of being
- then and there subjected to force

A full offence of theft must be committed.

Force can be a mere nudge.
Force can be used against a third party or indirectly to apprehend possession.

Force does not have to be used.
The threat of force is enough.
But…
It must be at that time and place

BURGLARY definition
Enters building or part of building
As trespasser
With intent to
Do unlawful damage to the building or anything therein
Or
Inflict GBH on any person therein
Or
Steal anything in the building or part of the building.

Having entered a building or part of a building.
As a trespasser
Inflicts or attempts to inflict GBH on any person therein
Or
Steals or attempts to steal anything therein

Commits any burglary
And at the time
Has with them any
- Weapon of offence
- imitation fire arm
- Fire arm
- Explosive
