Any assumption of. The rights of the owner. Applies also where D has not stolen the property.

A
A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it.

Includes money and all other property, real or personal, including things in action (Debt) or other intangible property (Cheque value, rights to land)

Does NOT apply where:
D believes he has the right to deprive V OR;
Believes V would consent if they knew the circumstances OR;
The person to whom the property belongs cannot be discovered by taking reasonable steps.
