What is the Work Product Doctrine?
A
Protects material prepared by attorneys (or their agents) in anticipation of litigation from being disclosed to opposing parties

Documents and tangible things prepared by attorneys or party

What is Ordinary Work Product?
A
- Factual information gathered for litigation
- May be discoverable in a civil case based on “substantial need” and the inability to obtain the substantial equivalent by other means without “undue hardship”

What is Opinion Work Product?
A
- Communications that include Attorney’s Mental Impressions, legal theories or strategies
- Nearly Absolute Immunity: except for rare circumstances
