What is the difference between the AIA and NSWRB?

A

AIA – professional body that serves the interests of the architectural profession, and aims to promote architecture to the community.

NSWRB – protects the interests of the community by ensuring architects provide architectural services in a professional and competent manner. This is through the registration of architects and informs the public of the qualifications and competence required to practice as an architect, while
promoting architecture to the community.

What are the powers of each body in the event of a claim for misconduct being upheld?

A

AIA – revocation of membership.

NSWRB – can issue a warning to the general public on their website with reference to the action of misconduct. For serious misconduct, the NSWRB can strip an architect of their registration status.

How does Australian Consumer Law control the behaviour of Architects?

A

Australian Consumer Law which forms a part of the Competition and Consumer Act 2010, governs the relationships between businesses and between businesses and consumers. ACL contains a number of implied guarantees benefiting the consumer, and in particular, a guarantee that goods or services provided are reasonably fit for the intended purpose.
However, the guarantee that services will be fit for a purpose does not apply to professional services provided by a qualified architect or engineer.

What is the Code of Conduct? What does it cover?

A

The code provides architects and their clients with a statement of the standards required of architects when engaged to provide architectural services. These standards differ to the standards defined in the Australian Institute of Architects Code of Professional Conduct.
It covers: Provision of architectural services generally; Disclosures of conflicts of interest; Provision of information to clients and prospective clients; Client Agreements; Building contracts; deposits and retainers; record keeping; professional indemnity insurance; professional development; representations concerning work; dealing with the public.

What are the Architects Regulations? What do they cover?

A

Regulations are delegated legislation, usually made by a Minister under the (Architects) Act to clarify or expand on particular aspects of regulation.
The most common day-to-day use of the Regulation is via the NSW Architects Code of Professional Conduct. The Code is given legal effect by being a part of the Regulation.
