P- these offence were legislated in an act in 1861. This ensures parliamentary soverignty as it is thier job to make the law.
Dp- however OAPA 1861 still operates today 160 years later.Outdated as society has developed so much that parts of the law no longer meets the need of society. Mental health wasn’t disccused.
Wdp - no attempt to reform the law so definition of key terms were not included. Many legal experts argue that is the Act is very dated, confusing, vague and illogical.
