what are the differences between a tort and a crime?
A
- a tort is a civil wrong while a crime is a public wrong.
- a tort traditionally arises from the breach of a legal duty while a crime arises from the breach of the penal code or other statutes.
- the complainant in tort is called the victim while in a crime the complainant is the state.
- a tort only entitles the victim to an action for liquidated damages whilst a crime attracts penal sanctions which are fixed by the statute.
