Capacity to enter into relations with other states

A
  1. Understood to signify independence from authority of other states and allows freedom of agreements.
  2. dependent on the willingness to enter into agreements and their interests.
    - shown through competences to enter into treaties
    - judicial competencies
    - self government from other entities
    Example - Taiwan isnt a state but operates as an independent entity.

Permanent Population

A
  1. no minimum number of inhabitants but must be permanent

Example: the Vatican city is recognised as a state with population mostly men and recruited asexually but is still classed as a state as it has a permanent population.

Defined Territory

A

Size of the territory doesn’t matter, it is whether it is being contested by another state.
Example: Kosovo claimed territory in Serbia within former Yugloslasvia. - Not a boarder dispute about the emergence of new states.
