What is capacity?
The ability to do something every day
What is the Mental Capacity Act 2005?
It protects those that can’t make their own decisions
Presumption of Capacity
We presume that everyone can make their own decisions until proven otherwise
Support to Make Own Decisions
Must be given all practicable help before anyone treats them as not being able to make their own decisions
Unwise Decisions
Not the same as lacking capacity, you may think a decision is unwise but everyone is different
Best Interests
You must make sure that the decision made is with their best interest, if they lack capacity
Less Restrictive Option
The option that gives them as much choice and freedom realistically possible
