Penalty points (page 125)
A
- there to deter unsafe motoring practices.
- the court MUST order points to be endorsed with range set by parliment.
- accumulation acts as a warning to drivers that they risk disqualification if further offences are committed.
- Accumulated of 12 or more penalty points within a three-year period MUST be disqualified. ( min 6 months)
- For every offence which carries penalty points the court has power to order the license holder to be disqualified. (Usually between a week and a month)
- in serious offences such as dangerous driving or drink driving the court MUST order disqualification. (Min 12 months). Second offenders in the space of 10 years get min 3 years disqualification.
- in some cases in addition to fixed disqualification they may have to pass a driving test.
