Employer responsibilities
-Upholding contracts and legislation
Obligations under the employment contract
- Pay minimum rates under the ‘real estate award’
- Compensate staff members for expenses
- Ensure workplace health and safety
- Maintain work cover insurance
- Pay superannuation
- Deduct an appropriate amount of tax
- Give notice to terminate employment
The real estate industry award
-Contains requirements in relation to pay, leave, hours, terminations and allowances
Commission only
- Registered salesperson or fully licensed agent
- Must already achieve a minimum threshold amount of 125% or more of the equivalent annual minimum wage
- Employee and employer must have a written agreement
- Held actual licence for at least 12 months within 3 years prior
- 21 years old
Commission entitlement if employment has ended
-May need to seek ‘fair work’ advice if in a dispute
Calculating number of hours worked
-38 hours per week
Reasonable additional hours
-Employer must not request a full time employee to work more then 38 hours per week unless the additional hours are reasonable
Working on a public holiday
-Employee will be entitled to a day off unless employer requires employee to work, however employees can refuse

- Completing required work within timeframe
- Following agency procedures and policies

- Confidentiality in dealing with certain work related information

-Policies and procedures documented in accordance with their established operating procedures

- Presentable and functioning laptop
- Well groomed
- Appropriate attire
- Professional presentation materials
- Well presented and clean vehicle
Work performance review
-Employers will conduct reviews to discuss whether the employers work performance is meeting expected agency and industry benchmarks
