The Development Of The Constitution Flashcards
Why and when was The Magna Carta signed?
It was signed by ‘Bad King John’ for the start of ‘the rule of law’ in 1215 to make sure the monarch operated within the framework of law.
What was included in The act of parliament in 1689:
-The bill of rights was made by parliament as it was anxious the monarch(s) at the time would ‘exceed’ their powers.
-This bill stated that PARLIAMENT IS SOVEREIGN and in control of governments finances and legislation. Also outlines specific rights and liberties that are protected from government infringement, ensuring that individuals have certain entitlements regardless of the political context
The Act of parliament 1701:
The Act of Settlement established the monarchs position as the RULER OF THE WHOLE OF THE UK at the time which was England, Scotland, Wales and all of Ireland.
The Acts of parliament in 1707:
The Acts of Union combined the Scottish and English parliament from abolishing the separate Scottish parliament.
However this changed in 1997 under the devolution acts.
The Acts of Parliament in 1911 & 1949 (think House of Lords)
They were both called The Parliament Act (of each year)
1911- They took away the HoL’s powers in public finances and TOOK AWAY THEIR POWER TO VETO A BILL completely and reduced capability to a two year delay of a bill. Reduced time between general elections from 7 to 5 years.
1949- The two year delay was reduced to a one year maximum. The result of the two made the commons the most senior.
The European Union communities act:
- 1972 it was agreed but the UK joined in 1973.
- this act brought the UK into the European Community (politically) which is now the EU
When was The European Union Notification of Withdrawal Act and what was it.
-introduced in 2017, and received royal assent in 2018. it gave parliamentary consent to the UKs exit from the European Union.
When was Scotland devolved under what act?
- Scotland was devolved under the 1998 Scotland Act which was implemented in 1999.
- The referendum in 97 asked if Scotland should have LAW VARYING AS WELL AS tax varying powers.
- The result was 74 to 26 in favour.
What is the importance of the Scotland Act 2016? And what did it include/entitle
-Some Scot’s still wanted full independence and the 2014 referendum showed 44% in favour of full independence.
-This caused the Conservatives, Labour and the Lib Dems to pledge to increase devolved power to them so Scottish nationalism didn’t grow out of hand.
- the main measure of the act included ‘widening the areas where Scottish parliament may pass laws’
The Act transferred new powers to the Scottish Parliament in areas including taxation, welfare, and the regulation of certain public services.
