How does Collective Bargaining takes place?
As per the Code of Practice under the 4th Schedule of the ERA 2008
What does the Code of Practice set out(describe/portray) in the Fourth Schedule? (Its purpose)
- Assists employers and T.Us to bargain effectively.
- Provides practical guidance for enhancing good employment relations.
- Provides practical guidance for obtaining negotiating rights.
What are the 4 main principles on which the Code is found?(Rule/Standard/Value/Belief)
(a) The employer and his workers have a common interest in the success of the undertaking. (Have the same objectives)
(b) Good human relations between employers and workers are essential to good employment relations.
(c) Good employment relations are the joint responsibility of mgt, workers, and the T.Us representing them.
(d) The best method of conducting employment relations is to carry out Collective Bargaining between the employers and the strong representatives of T.Us in a reasonable and constructive way.

Explain ‘Harmonious Employment Relations’. (Need to do)
Both mgt and T.Us need to work together to create and sustain a positive(harmonious) employment relations environment.

Explain ‘Bargaining in good faith’.
(What do the parties need to do after recognition, Requirements)
Where a T.Us (/a group of T.Us) have been recognised as a bargaining agent, the T.U /(the group of T.Us) and the employer shall bargain in good faith.
Bargaining in good faith requires the T.U/group of T.Us and employers to;
1) Meet and discuss meaningfully ; a) a collective agreement(/any variation of one), including initiation of the bargaining or renewal of the collective agreement \+ b) any matters related to the agreement while in force.
2+3) To do their best to quickly enter into procedure agreements and find mutually acceptable solutions.

Personal interaction between;
i. Managers and their direct subordinates

T.Us are expected to take an active role when it comes to employment relations matters to improve workers’ working conditions while promoting job (creation + preservation).
T.Us are set to expand their focus to include ‘new issues’, like;

iii. Technological & org.al innovation(TOI)
iv. Flexibility
v. Training
vi. Employability
vii. Performance-related pay schemes(PPS)
viii. Enterprise competitiveness.

Principal aim of T.Us of workers;
Strive(Fight/Attempt) to support(promote) the well-being of their members by ensuring the success of the companies where they work.
Interested in working together to improve efficiency + share the responsibility with mgt for maintaining positive employment relationships.
Workers’ T.Us must work together with mgt to establish effective processes for;
i. Negotiation
ii. Consultation
iii. Communication
iv. Resolving conflicts and disputes.
Explain ‘Building up Shared Values’.

Both mgt and T.Us recognise that they have;
i. Legitimate
ii. Different
iii. Common interests.
Accepting differences between mgt and T.Us can lead to a more structured, proactive approach to;

Good employment relations = Joint responsibility
But mgt holds the primary responsibility for their promotion.
