why was the Charter of the French language introduced?
low rate of francophone’s birth, immigrants chose English over French, it was difficult to receive service in French (business chose English over French)
what is the goal of the CFL?
to preserve the quality and status of the French language, French is the official language for government action, education, commerce and workplaces
what is the role of the « office de la langue francaise » ?
- to inform businesses and consumers of their language rights 2. to promote the use of good/quality French 3. address complaints of breaching obligations under the Charter
why does the CFL exist in qc?
Because French is more threatened here than in Europe (demographic/geographic purpose) , it is part of the QC culture (heart of it) and French attracts tourists
what it section 45 of CFL?
it stipulates that an employer is prohibited from dismissing, laying off or transferring a member of his staff for the SOLE reason is that he exclusively speak French or because he as demanded a right from the Charter to be respected
what is section 46 of the CFL?
an employer cannot make the obtaining of an employment dependent upon the knowledge of a language other than the official language unless the nature of the duties requires such knowledge (meaning an employer cannot not hire someone bc he does not talk English)

the employer must show that the knowledge of the other language is important and necessary in the needs of the business
what are the requirements for enterprises with 100 employees and more?
must have a francization committee of 6 people ore more, can have a francization certificate but can have to adopt a francization program if the use of French is not generalized at all levels
what are the requirements for 50 or more employees?
they must register with OQLF and transmit an analysis of its linguistic situation, they can be subject to the implementation of a francization program or the creation of francization committee
what are the requirements with less than 50 employees?
maybe they will require to implement a francization program (but they need the Ministry approval)
how must enterprises show compliance with OQLF?
once granted a francization certificate, enterprises must submit progress every 3 years, and should complied with the section 45 and 46 of the CFL or they will have penalties
