What is an Employee?
a person hired to complete specific tasks in return for monetary payment
What is an Employer?
person or organisation that hires workers to complete specific tasks and in return pays them
Employer Responsibilities
- Pay the minimum wage
- Pay appropriate sick leave
- Provide paid holiday leave
- Pay superannuation contributions
- Provide sufficient work breaks
- Provide a safe work environment
- Ensure there is no unlawful workplace discrimination
Employee Responsibilities
- Complete the required hours of work
- Be honest and accurate with money
- Keep certain business information confidential
- Give required notice before leaving
- Obey workplace rules such as safety and anti- discrimination rules
What is an Enterprise Agreement
An agreement about wages and working conditions bargained and made directly between employers and employees that must be approved by the Fair Work Commission. If there is one of these in an organisation, then the award does not apply

What is a Modern award?
A modern award is a document which sets out the minimum terms and conditions of employment on top of the National Employment Standards
What are some National Employment Standards?
- Maximum of 38 weekly hours of work
- Requests for flexible working arrangements
- Offers and requests for casual conversion
- Parental leave and related entitlement
- Leave
- Public holidays
- Notice of termination and redundancy pay
- Given the Fair Work Information Statement
What is discrimination?
The practice of treating a person (or group) differently from another person based on their personal characteristics
What is Direct Discrimination?
Occurs when someone makes it very clear why they are treating you less favourably. For example, when someone says that they will not employ you because you are a woman
What is Indirect Discrimination?
Occurs if a person with a particular attribute is required to comply with an unreasonable requirement, which a person without that attribute could comply with
For example, if a potential employer required all employee to be above a certain height and there was nothing in the job that required a person to be of a certain height.
Two conditions that must be present for discrimination to occur?
- The person must have been disadvantaged in the workplace due to one or more types of discrimination
- The discrimination must have resulted in an action being taken that was ‘adverse’ (negative) to the person

What is sexual harassment?
NOT MUTUAL ATTRACTION. Sexual behaviour that is unwanted or unwelcome and can make the recipient feel offended, humiliated, ashamed, embarrassed, intimidated or frightened
What is bullying in the workplace?
Workplace bullying is a persistent pattern of mistreatment from others in the workplace that causes either physical or emotional harm.
What are examples of bullying?
such tactics as verbal, nonverbal, psychological and physical abuse, as well as humiliation

How do you determine bullying?
A person or group of people must have behaved unreasonably to a worker or a group of workers at work.
The bullying must have occurred repeatedly.
The bullying created a health and safety risk
What is Unfair Dismissal?
When an employee is dismissed from their job in a harsh, unjust or unreasonable manner
What is summary dismissal
employer dismissed the employee without notice or warning because the employee’s conduct is serious enough to justify immediate dismissal
Some examples of summary dismissal are?
theft, fraud, violence, not following important health and safety procedures
