1 Amendment gives the right to: (5)
Free speech, religion, press, protest, and petitioning the government
What two things can the government NOT do w/ religion?
Make an official religion of the country or prevent people from following their religion
5 limits to free speech
Clear and present danger, fighting words, obscenity, sedition, slander
Incorporation
Amendments apply to federal, not state govt. Supreme Court has found that the 14th Amendment incorporates the bill of rights into the states
2 Amendment
Says it is necessary to have a militia, and people have the right to bear arms
3 Amendment
No quartering of troops
4 Amendment
No unreasonable searches
5 Amendment
Accused must have grand jury when charged with a serious crime, no double jeopardy, protection from self-incrimination, eminent domain
6 Amendment
Right to impartial jury, speedy trial, an attorney
7 Amendment
Right to a jury trial in civil court case if suit if for $20 or more
8 Amendment
No cruel and unusual punishment, no excessive bail
9 Amendment
Just because it isn’t on the list, doesn’t mean it’s not a right protected by Constitution
10 Amendment
Any power not given to the natl govt or denied to the states, goes to the states
Amendment can be made if
2/3 of congress and 3/4 of states ratify
