Explain Boomer v. Atlantic Cement Company and why the outcome occurred

A

Atlantic Cement Company (Albany, NY) was brought to court b/c they were being sued by neighboring landowners due to alleged injury to property from dirt, smoke, and vibrations emanating from the plant. They sought an injunction but it was denied and only $185,000 was awarded to compensate.

Financial consequences of a permanent injunction would have been too extreme since there were $45m and 300 jobs at stake. It would have been too much of a financial strain on employees and NYS.
