Read when it is satisfied that a riot is occurring
s. 25 (1) CC - Protection of Persons Acting Under Authority
Conditions must be met:
- “required or authorized by law to do anything in the administration or enforcement of the law”
- The requirement or authorization must be something found in a statute or common law
- Person must act on reasonable grounds
- Only as much force as Is necessary to achieve that purpose
s. 25 (2) - Protection of Persons Acting Under Authority
People are protected if they “act in good faith” while being authorized to do something (“to execute a process”) or complete a task (“complete a sentence”)
- Protected even if the document is flawed
- Even people who are assisting an authorized person are protected
s. 25 (3) - Not Protected
No one is allowed to use force that would (or is likely to cause death or grievous bodily harm unless the person believes on reasonable grounds that it is necessary for the self-preservation of the person or the preservation of any one under that person’s protection from death or grievous bodily harm…
s. 25 (4) - When Protected
Peace officer/assistant attempts to arrest for arrestable offence
- Person flees to avoid arrest
- Peace officer or other person using force acts protecting the peace officer, person assisting the peace officer or any other person from imminent or future death or grievous bodily harm
- Flight cannot be prevented by reasonable means in a less violent manner
s. 25 (5) - Escape Penitentiary
lethal force may only be used against an escaping inmate if a peace officer has RG belief that inmate poses threat of grievous bodily harm to any person and escape cant be prevented by reasonably less violent means

- Unless he or she believes, on RG, it is necessary in order to protect against loss of life or serious bodily harm

- (a) to call for assistance in a critical situation, if there is no reasonable alternative; or

A police officer must submit a use of force report whenever he/she:
- Draws a handgun in the presence of a member of the public
- Points a firearm at a person
- Discharges a firearm
- Uses a weapon other than a firearm on another person
- Uses physical force on another person that results in an injury requiring medical attention

- Use force on a person unless the officer has successfully completed a training course on the use of force
- Carry a firearm unless the officer successfully completed a training course on the use of firearms

- (1) Every peace officer is justified in using or in ordering the use of as much force as the peace officer believes, in good faith and on reasonable grounds,
(a) is necessary to suppress a riot; and
(b) is not excessive, having regard to the danger to be apprehended from the continuance of the riot

Section 69 CC - Neglect by Peace Officer
- A peace officer who receives notice that there is a riot when within his jurisdiction and, without reasonable excuse, fails to take all reasonable steps to suppress the riot is guilty of an indictable offence and liable to imprisonment for a term not exceeding two years

- receives notice that, at any place within the jurisdiction of the person
- 12 or more persons are unlawfully and riotously assembled together
- Shall go to that place and, approach as near as is safe
- if satisfied that a riot is in progress, shall command silence and then make or cause to be made in a loud voice a proclamation in the following words or to the similar effect:
- “Her Majesty the Queen charges and commands all persons being assembled immediately to disperse and peaceably to depart to their habitations or to their lawful business on the pain of being guilty of an offence for which, on conviction, they may be sentenced to imprisonment for life. GOD SAVE THE QUEEN.”
