What is curtilage?
Land immediately surrounding a dwelling, including immediate sheds. Does not include paddocks.
Where you would have a reasonable expectation of privacy.
What is evidential material?
Evidence of the offence.
Can be tangible or intangible.
What is a private premise?
Building area not accessible to the public , where you would expect privacy.
What is a non-private premise?
Area or part of area which public can frequent and would not expect privacy.
What is a private activity?
An activity you ought reasonably to expect not to be observed or recorded except by those participating in the activity.
What is a surveillance device?
Interception device, tracking device, visual surveillance device.
Anything that may enhance your normal senses.
What is trespass surveillance?
Surveillance that involves trespassing.
What is unlawfully at large?
- Warrant
- Prisoner
- Escapee from custody (police, mental health, Oranga Tamariki)

RGTS
Having a sound basis for suspecting that a situation or circumstance exists.
Example: you enter a house because you suspect an offence has been or is about to be committed there.
RGTB
Having a sound basis for believing that a situation or circumstance exists.
Example: enter a house because you believe the search will find evidential material.
Tangible
Able to be touched
Intangible
Unable to be touched; not having physical distance
CADD
Concealed- burying, hiding, moving
Altered- changing it, removing serial numbers in attempt to disguise
Damaged- cutting or breaking
Destroyed- consuming food items etc, burning clothing
Obligations
(Under 131)
Identification- name, identity if not in uniform, intention, act, notice by search warrant, BOR
Reason- reason for the search
Notice- copy of the search warrant
Exceptions- RGTB no one is present, danger to life, prejudice
