What is the constitution?
A constitution is a set of rules that govern a country
What is the separation of powers?
legislative, executive, judicial
What does the legislative do?
makes laws
What does the executive do?
enforce laws
What is the judicial do?
interpret laws
Who makes up the legislative?
senate (upper house), house of reps (lower house)
Who makes up the executive?
Prime minister (government)
Who makes up the judicial?
High court

What is constitutional law?
government laws that only the government can make
What 4 things does the constitution do?
- establishes and lists the powers
- creates rules that are to be followed by different branches of government
- establishes processes for elections
- protects fundamental rights (rights that protect individuals)
What is statute law?
Statute law is written law made by Parliament.
What is common law?
Common law is judge-made law based on precedents.
What is the order of courts?

What is a precedent?
rules established by courts which is then applied to cases with similar issues or facts.
What is a binding precedent?
Binding precedent must be followed by lower courts.
What is a persuasive precedent?
Persuasive precedent can influence but is not mandatory to follow
