What is relief by separation of liability and how does one qualify?

A

An individual can allocate any understatement of tax between the individual and their spouse making them only responsible for their own portion of underpayment.

They must have filed a joint return
The individual is no longer married (or is separated)
The individual was not a member of the same household as the spouse with whom the joint return was filed.

A

With innocent, this is relief from tax liability owed upon filing due if it can be established that the spouse did not know of the other spouses underpayment of taxes

With injury, not only is it the above, but it is the unfreezing of assets or returns to pay for those underpaid liabilities based on the same fact, that the one spouse did not know of the others tax underpayment activities.

No, because na IRA is not a qualified plan. Instead, it would simply be a DRO.

A
