What is the subsidiarity principle?

What makes the ECHR a ‘special treaty’?
A
- More than just reciprocal engagements - Collective enforcement of HR
- Aim is to achieve greater unity between MS
- How? By maintaining and further realizing the protection of HR
- Does not require uniformity but a minimum level of protection

- To give individual justice to the applicants
- Not fourth instance!
- To develop, elucidate and safeguard the rules instituted by the Convention - Art. 30, 37(1) and 40:

- Takes long to change legislation

- Because ECHR is a living instrument
- Must take into account consensus, culture and history amongst the MS
- In this, the court uses the consensus/comparative method of interpretation
