Tactical Options Framework (TOF)
This is a guide which allows us to assess when, how and what level of force to use. Using the force necessary and proportionate, given all circumstances.
TENR: what is T?
Threat: an individual or group or act likely to cause harm or have the potential to obstruct police and their duties. - intent, capability, opportunity, environment
TENR: what is E - EXPOSURE?
Potential for harm (physical or otherwise) to people or the security of places or things. Exposure can be lighten through assessment and planning.
TENR: what is N - NECESSITY?
Is the assessment to determine if there is a need for the operation or intervention to proceed now, later or not at all.
TENR: what is R?
Means the proportionate and timely execution of police duties aided by the appropriate use of tactics and tactical options
Crimes act 1961
SECTION 39
Use of force to carry out on arrest or executing a warrant or process.
Crimes act 1961
SECTION 40
Use of force to prevent a person trying to avoid arrest or to escape after arrest.
Crimes act 1961:
SECTION 41
Use of force to prevent suicide or certain offences.
Crimes act 1961:
SECTION 42
Gives justification to those witnessing a breach of the peace to interfere, using force if necessary, to prevent the disturbance from continuing or restarting.
Criminal act 1961:
SECTION 48
Looks at the justification of the use of force in self-defence or the defence of another.
Reasonable use of force
Reasonable force includes force that is necessary and proportionate (enough for situation), given all the circumstances known at the time.
Crimes act 1961:
SECTION 62
Everyone authorised by law to use force is criminally responsible for any excess, according to the nature and quality of the act the constitutes the excess. (Use too much force)
Explain the liability imposed by
section 62 for excessive force
Everyone Authorised by law are criminally responsible for action going beyond the act.
Policing act: Section 32
Identifying particulars of person in custody. If in lawful custody, an officer may take finger prints, foot prints, photos other personal details. May use reasonable and necessary force to obtain.
Policing act 2008: Section 33
Identifying particulars for summons, power does not extend to taking person back to the station for this purpose. Will only be useful if officer with equipment on hand.
