Lower states sided with the state of Wiconsin, but SCOTUS, sided with the families. The decision resulted in 6-1, and the children were then allowed to stay home.

Clarence Earl Gideon, a man in Florida was convicted of robbing a pool house. He asked the state to provide a lawyer for him, and they refused to because he didn’t commit a capital crime. He was then sentenced to a five-year prison sentence in which he educated himself on law and how it works; he selectively incorporated the fourteenth and sixth amendment right. By doing so he wrote a letter to the supreme court appealing his case because of his findings. The court did just that and found that the state of Florida violated his 6th and 4th amendment right.

The state of Florida is arguing that they did not need to provide a lawyer, while Gideon is arguing that under the 6th and fourteenth Amendments, a lawyer had to be given/provided to him.
