When to go to Supplemental Jurisdiction?
FIRST need to show that diversity or FQ jurisdiction does not get us there
Two steps to use supplemental jurisdiction
1) Additional claim must share a “common nucleus of operative fact” with the claim that satisfied federal SMJ
2) Plaintiffs cannot invoke supplemental jurisdiction in diversity cases
HYPO: The only time P gets to use supplemental jurisdiction in a diversity case
P1 and P2 are both citizens of Virginia, sue D, a citizen of Pennsylvania, on state-law tort claims.
P1’s claim is for $100,000. P2’s claim arises from the same transaction or occurrence, and is for $50,000.
P1’s claim meets the requirements for diversity, so that gets the case into federal court, BUT P2’s claim does not meet the requirements for diversity
because it does not exceed $75,000.
