  1. Plaintiff’s own cause of action, in a well-pleaded complaint, shows that it arises from federal law (Mottley)
  2. The case really and substantially involves a dispute respecting validity, construction, or effect of federal laws (Shulthis/Smith)
  3. Federal law creates the cause of action (American WW)
  4. The case necessarily raises a federal issue, actually disputed and substantial,, and the federal court can hear it without disturbing fed/state balance of judicial responsibilities
