Section 7 Charter
Everyone has the right to life, liberty and security of the person and the right not to be deprived thereof except in accordance with the principles of fundamental justice.
Section 8 Charter
Everyone has the right to be secure against unreasonable search and seizure.
Section 9 Charter
Everyone has the right not to be arbitrarily detained or inprisoned.
Routine traffic stops are ok (not arbitrarily detention) to check DL, Reg, Ins, Insp, Sobriety of driver, questions outside this realm are not acceptable when put to the driver. Articuable cause must be given.
Section 10 Charter
Everyone has the right on arrest or detention
(a) to be informed promptly of the reason therefor,
(b) to retain and instruct counsel without delay and be informed of that right,
(c) to have the detention validated by way of habus corpous and to be released if detention is unlawful.
• Police must refrain from attempting to elicit information from a detainee until they have had a reasonable opprtunity to retain and instruct counsel, unless they waive their right to counsel. (R v. Manninen SCC)
• Waving Counsel - did the detainee understand what was said, did they have sufficient information to permit them to make a reasonable decision not to exercise right to counsel. (R v. Evans SCC).
• Detainee must be diligent in attempting to contact counsel, if they weren’t and the police question them, it is permitted. (R v. Tremblay SCC)
• Police must inform the detainee of the existence and availability of duty counsel and legal aid. (R v. Brydges SCC).
• Once the detainee asserts the right to counsel, there must be a clear indication of the change of mind, waiver to speak to police must be free and voluntary, not the product of direct or indirect compulsion. (R v. Prosper SCC).
Section 24(2) Charter
The accused bears the burden of convincing the court that evidence obtained in breach of the charter should be excluded under 24(2).
• The standard of proof is a balance of probabilities - more probable than not the administration of justice would be brought into disrepute if evidence was admitted.
• Community Shock rule. Views of the community/admission or exclusion would result in greater disrepute to the administration of justice.
