Statutes Flashcards
The jurisdiction has a statute that allows contribution based upon proportionate fault and adheres to the traditional common- law rules on indemnity.
When 2 or more tortious acts combine to proximately cause an indivisible injury to a plaintiff, each is held jointly and secret for that injury. (Each liable for the entire damage) even if each tortfeasor acted independently
The court adapted Pure comparative negligence doctrine, with joint and several liability in place of the common law rule relating to plaintiff’s fault.
Each d is liable for their share and one d can be held to pay for all D’s share
Joint and several liable
Defendants act in a manner such that their separate acts combine to harm the p in one indivisible injury.
