Reply to a defence:
A
- 7:
- C who does not reply to a defence shall not be taken to admit the matters raised in the defence
-C who files a reply to a defence but fails to deal with a matter raised in the defence shall be taken to require that matter to be proved

Period for filing a defence:

- 14 days after PoC
- Or, if AoS was served, 28 days after service of PoC - 5:
- D + C may agree to extend the duration that the period for filing a defence up to 28 days - if done so must notify the court in writing

- 6 months after the expiry date of filing a defence, if no defence, admission or application for summary/default judgment then claim shall be stayed

Changes to parties:

- the court may order a person to be added as a party if:
(a) it is desirable to add the new party so the court can resolve all the matters in dispute in the proceedings
(b) there is an issue involving the new party and an existing party which is connected to the matters in dispute in the proceedings and it is desirable to add the new party so the court can resolve that issue

- The court’s permission is required to remove, add or substitute a party unless the claim form has not been served
- An application may be made without notice and must be supported by evidence
