What is a football banning order?
An order prohibiting attendance at regulated football matches anywhere in the UK. They are issued in the following way…
CONVICTION OF A RELEVANT OFFENCE
- relevant offences include drunkenness, violence and public order
- these offences can be committed going to or from football matches (wether the offender goes in or not) or at or in connection with matches
- these are MANDATORY if the court believe it would help prevent further violence or disorder
- the order will last; 6-10 years if the conviction involves imprisonment and 3-5 years if no imprisonment
COMPLAINT BY THE CHIEF OFFICER OR DPP
- where a person has been involved in violence or disorder in the UK or elsewhere, an application can be made to the court for a banning order
- these order require a person to surrender their passport in regards to overseas matches and to notify the enforcing authority of any changes to personal circumstances.

What are the powers of detention in regards to banning orders?

- 5 days before the day of the match
- ending when the match is finished or cancelled
- (for a tournament) 5 days before the first match
- (for a tournament) until the last match finishes or cancelled
Only a CONSTABLE IN UNIFORM may detain someone and only a BRITISH CITIZEN may be detained
A person may be detained if…
- the constable BELIEVES an order would prevent violence and disorder in relation to a football match
- the person has been involved in violence or disorder anywhere in the world
The officer can detain someone for up to 4 HOURS until they decide if they will issue them with a notice and must give the grounds for detaining them IN WRITING.
The notice issued is essentially an application for a banning order and is a direction to the person to attend court for a hearing
- an INSPECTOR OR ABOVE can extend this detention period to 6 HOURS. The inspector does NOT need to be present or in uniform to do this.
