A

Any person who, at a DESIGNATED FOOTBALL MATCH…

  • throws anything
  • towards the playing area
  • any place adjacent to the playing area where spectators are not admitted
  • any area where persons are or might be
  • without lawful authority or excuse

…OR…

  • engage in any chanting of indecent or racist nature

…OR…

  • go onto a playing area
  • any area adjacent to the playing area where spectators are not normally allowed
  • chanting includes words or sounds, together with others or alone but there MUST BE REPEATED WORDS OR SOUNDS TO BE CHANTING. 1 world or phrase or sound would not count

What are the relevant times for a “designated football match?

A
  • 2 hours before the games starts or is advertised to start
  • 1 hour after it ends
  • if the match ends up not taking place; 2 hours before it was advertised to start until 1 hour after it was advertised to start

What is a football banning order?

A

An order prohibiting attendance at regulated football matches anywhere in the UK. They are issued in the following way…

CONVICTION OF A RELEVANT OFFENCE

  • relevant offences include drunkenness, violence and public order
  • these offences can be committed going to or from football matches (wether the offender goes in or not) or at or in connection with matches
  • these are MANDATORY if the court believe it would help prevent further violence or disorder
  • the order will last; 6-10 years if the conviction involves imprisonment and 3-5 years if no imprisonment

COMPLAINT BY THE CHIEF OFFICER OR DPP

  • where a person has been involved in violence or disorder in the UK or elsewhere, an application can be made to the court for a banning order
  • these order require a person to surrender their passport in regards to overseas matches and to notify the enforcing authority of any changes to personal circumstances.
  • these orders last 3-5 years

What is the offence of failing to comply with a banning order?

A

Any person who…

  • fails to comply with any requirement of the order
  • any written notice to attend a police station or surrender their passport in advance of certain matches

What are the powers of detention in regards to banning orders?

A

These apply in relation to matches OUTSIDE THE UK and during the CONTROL PERIOD of a football match. These periods are…

  • 5 days before the day of the match
  • ending when the match is finished or cancelled
  • (for a tournament) 5 days before the first match
  • (for a tournament) until the last match finishes or cancelled

Only a CONSTABLE IN UNIFORM may detain someone and only a BRITISH CITIZEN may be detained

A person may be detained if…

  • the constable BELIEVES an order would prevent violence and disorder in relation to a football match
  • the person has been involved in violence or disorder anywhere in the world

The officer can detain someone for up to 4 HOURS until they decide if they will issue them with a notice and must give the grounds for detaining them IN WRITING.

The notice issued is essentially an application for a banning order and is a direction to the person to attend court for a hearing

  • an INSPECTOR OR ABOVE can extend this detention period to 6 HOURS. The inspector does NOT need to be present or in uniform to do this.
  • a person cannot normally be detained twice in the same control period

  • instructing a person to a magistrates court in a particular date

Any person who…

  • if the vehicle is a public service vehicle and they are the operator or servant or agent of the operator
  • if the vehicle is hired and they are the person whose it is hired from or the servant or agent of that person
  • knowingly causes
  • knowingly permits

…alcohol to be carried on any such vehicle

…OR…

  • has alcohol in their possession while on the vehicle

…OR…

  • is drunk on any such vehicle
