7.1.1 General

A
  • Employee required to operate vehicle must have/maintain valid FL. Drivers License
  • Commercial DL with proper endorsement (for the type of vehicle) is required for employee driving BSO commercial vehicle. Exemption of commercial DL is for employees operating vehicle with audible warning devices, red/blue lights, and responding to 911 calls

7.1.2 Drivers License Reporting

A
  • Expired, suspended, revoked DL cannot drive BSO vehicle or any vehicle while conducting BSO business, also cannot drive ANY vehicle on BSO property
  • Must report expiration, suspension or revocation of - DL to supervisor. Must correct in 10 business days unless extension granted by IA
  • Failure to report all the above, correct issue, or repeated violation goes to IA for investigation

7.1.3 Driver License Validation

A
  • DL validity checked 1x a month thru DHSMV by Human Resource Information manager (HRIM)
  • HRIM gives any affected personnel a report to IA. IA will notify the persons command
  • Command takes action to ensure person rectifies within 10 business days. Person will then send copy of rectified DL to HRIM in event of address change, DL expiration, suspension, revoke, reinstatement

7.2 Take-Home Vehicle Program

A
  • Sheriff directs assigned BSO vehicles to personnel.
  • Makes policies/procedures for assigned usage
  • Person assigned vehicle must comply with Florida Statue and agency policy
  • Use of vehicle off duty is privilege, not a right. Do not presume special privilege, must obey state/local laws, and regulations with traffic/parking.
  • Assigned vehicles limited to tri-county area
  • Person living outside tri-county are not to take vehicle home. Leave outside secure BSO location and arrange transport to/from home.
  • Can use vehicle off duty when living in Broward
  • Living in Miami/Palm Beach only use car to drive to/from work and off-duty within county the person lives and Broward if person is on-call
  • Transporting passengers (not employees, suspects, arrestees, victims/witnesses) must carry additional insurance obtained by employee
  • Use of vehicle outside tri-county, restricted to official business with sheriff/designee approval
  • Only employee assigned to vehicle can drive it. No valet use. Authorized car wash locations exempt
  • Sheriff can assign, deny, suspend, remove employee from take home program.

7.2.3 BSO Vehicle Assignment Policy

A
  • Vehicle assigned by optimum service to community & low cost equipped with lights and sirens
  • HR processes BSO A#183 form to activate/inactivate vehicle for unrepresented employee given by sheriff discretion. Discontinued automatically end of each year, new form needed to reactivate for special functions, frequent after hours call outs, long travels other than assigned work locations before duty hours, critical call out times to preserve life/health/safety/welfare of residents
  • If not in CBA, sheriff discretion-may issue vehicle for reimbursement, loan vehicle for civilians work related assign to be returned when shift ends. Loaner/pool vehicle more than 7 days-need written approval from Dept Executive Director, not to be used by person getting vehicle allowance
  • Non-sworn person other than for business use, employer-provided vehicle is taxable. Must complete Quarterly Vehicle mileage report BSO A#20a. Submit to Payroll within 10 days at end of each quarter
  • Failure to submit form, may be suspended or removed from take home program or IRS consequences.

7.2.4 BSO Vehicle Replacement and Inspections

A
  • Fleet Division Manager approves in writing vehicles. Employee reviews inspection report from Fleet to sign before receiving/returning vehicle. Operator responsible for damage/missing equipment

7.2.5 Passengers in BSO Vehicles

A
  • May transport employees/work related person in vehicle on duty
  • Employee living in Broward may transport non-work related approved persons in vehicle to locations in
  • Broward when on call or driving to/from work only.
  • Employee living in Miami-Dade/ Palm Beach County can transport non work related approved passenger in vehicle within their county of residence when in on-call status and met insurance requirements.
  • Cannot transport non-work related passengers in vehicle driving to/from work which is not considered on-call
  • Insurance- non-work related passenger need minimum limits $100,000 per occurrence, $300,000 aggregate liability coverage with complete “Liability Insurance Affidavit” as proof. Will provide copy to Risk Management within 24hrs of accident or request
  • If DLE goes to felony call with civilian in car, leave person at safe location or secure them when arrive at scene. Will not respond to emergency with civilian passenger unless supervisor approved or to protect lives. Exceptions to this need approved writing by Undersheriff.

7.2.9 Alcohol/Drugs in BSO vehicle

A

No alcohol put in vehicle unless confiscated in line of duty. No drugs in vehicle unless lawfully Rx or confiscated in line of duty

7.2.12 BSO Vehicle Security

A
  • Don’t leave vehicle running or unattended whether locked/unlocked unless K9 inside. Failure to secure vehicle, employee may be financially responsible for contents except where item permanently mounted
  • Trunk acceptable storage location. Sensitive equip should not be left inside during off-duty except for items secured in mounted lock box or trunk with cable lock

7.3 Vehicle Operation Procedures

A
  • 7.3.2 Vehicle Response Mode
    -Code 1- routine
    -Code 3-Emergency. Full and Continuous use of all audio/visual warning devices. Max exceed speed limit that don’t endanger life or property. May go past red light/ stop signs only after safe passing.
    -Deputy discretion to go Code 3. This does not relieve their responsibility of due care
  • 7.3.3 Off Duty Radio Communication
    -If not assigned radio, use CCN as ID if off duty
  • 7.3.4 Off Duty Law Enforcement Action
    -Proper handling of calls. Request zone unit for response. To preserve evidence, on duty supervisor may direct off duty (off going) deputy to handle the call. OT for off duty required to take DLE action in assigned vehicle. If directed to take a call off duty, normal OT applies. Plain clothes deputy maintain good judgement and common sense
  • 7.3.5 Vehicle Operation without Headlight
    -BSO allowed no headlights when needed for DLE function per FL Statue. Function=needed for performance, vehicle in compliance with policy/procedures, can be safely accomplished. Still use due regard, violation of this section is noncriminal infraction

7.4 Vehicle care and Equipment
7.4.1 Employee Care of Vehicle

A
  • Personally responsible. Will perform maintence and care. Daily check fuel, oil, water, battery. Only use BSO fuel, oil, lubricants and other additives.
  • Do not connect electronic gear in vehicle system with written permission from Fleet. No modification of computer chips. No removal, replacement, or obscuring BSO issued license plate
  • Keep clean all times.
  • Flat tire changed by towing service under BSO contract. No self changing of tire expect emergency with supervisor approval.
  • Inspect vehicle once a month and document

7.5 Vehicle Crash/Damage

  • 7.5.2 Reporting
    -Report accident, property damage, or non-contact incident to local law enforcement, local FD if needed, BSO Communications to notify closest on-duty road patrol supervisor, and supervisor
  • 7.5.3 Authority To Conduct Traffic Crash Investigation
    -Within Broward- BSO conduct traffic crash involving BSO vehicles within district with Fl Crash Report Long Form.
    -Closest BSO district to conduct traffic crash involving BSO vehicle in non-BSO district.
    -If BSO and another agency involved in crash, 3rd party jurisdiction will conduct accident. If unable, agency with patrol responsibilities will conduct accident.
    -Traffic Homicide investigates all crashes involving BSO vehicles when anyone is transported to hospital
    -Outside Broward- agency with jurisdiction will conduct crash with BSO involved vehicle.
  • 7.5.4 Authority to Conduct Property Damage Investigation
    -Within Broward- BSO to conduct criminal or noncriminal property damage involving BSO vehicle in district. O.S.S.I. incident report to be done.
    -If property damage is associated with prisioner transport & resulting from action taken by prisioner, transporting BSO deputy will create O.S.S.I. incident report or supplement report. Will not delay transport

7.6 Crash Review Board (CRB)
7.6.1 Procedure

A
  • Risk Management reviews documents using National Safety Council Guidelines and make recommended finding of preventable or nonpreventable. Then sent to Executive Director, Dept. Of Professional Standards or designee for approval or non-approval.
  • If preventable, procedures in this chapter will be followed and require appropriate driver awareness program.

7.7 Crash Review Process
7.7.2 Procedure- Fire Rescue

A
  • Following is for crashes deemed preventable. Initial determination by Risk Management will be forwarded to CRB for final determination. Employee can appear before CRB with union rep and witnesses to present case. After, CRB will render decision
  • If deemed preventable, recommend discipline by Executive Director, Dept of Prof Standards with point system in the preventable accident review guidelines. Employee then offered pre-discipline conference to be heard but can waive conference or representation. Employee may appeal disciplinary action

7.10 Stopping on Roadways

A
  • 7.10.1 Disabled BSO vehicles
    -If BSO vehicle is disabled with any part in roadway, use warning flares and/or reflective cones and visual warning devices
  • 7.10.2 Assisting Motorist
    -Use visual warning devices, notify command, park BSO in safe manner, don’t use BSO vehicle to jump private vehicle.
  • 7.10.3 Disabled Vehicles Posing a Safety Hazard
    -If vehicle in road poses serious safety hazard, may physically push vehicle to clear roadway. Allow motorist to select towing service or request BSO approved tow truck. Use push bar/push bumper if their vehicle is equipped and meets requirements

7.11 Use of Seat Belts

A

Requires use per FL Statues. Exception “dignitary” passengers will be seat-belted at all times while being transported in BSO vehicle.

7.15 Red Light Camera/Toll Policy

A
  • 7.15.1 Red Light Camera Violation
    -FL Statue 316.072 except when responding to emergency or fire alarm, all personnel are not exempt from violations. Must operate BSO vehicle in compliance with state and local/municipal traffic law
    -If driving BSO Vehicle, on or off duty, violate Red Light Camera, will have case sent to IA for review. Employee may contest violaton with issuing authority. If not dismissed, notify IA and command of outcome.
    -Will be responsible for paying all fines. IA will request the issuing authority to have violation dismissed pursuant to IA review. If dismissed, will forward to assigned command. Will identify driver, custody of vehicle on date/time reflected on notice violation. Supervisor reviews documents to determine if operation were consistent with BSO policy
    -If issuing authority does not agree to dismiss, violation sent to vehicles assigned command. Supervisor, not employee, will perform due diligence to find who was driving at time and complete Post Uniform Traffic Citation Issuance Affidavit and give responsibility to that employee
    -IA will record violation and outcome
  • 7.15.2 Toll-way Procedure
    -Person driving BSO owned vehicle is exempt from toll payment when on official business.
    -Personnel use dept issues non-revenue SunPass installed by Fleet. Do not remove or transfer SunPass.
    -If in need of commercial SunPass, fill out SunPass Authorization Request/Renewal Form. Submit to Fleet Division thru Chain of Command
