Initial roadside requirement
I am Constable Thomson, the reason you have been stopped is for the purpose of a preliminary breath test.
I require you to provide a sample of your breath and to wait at this place until that test is complete.

Requirement to accompany

I believe you to be the driver of a vehicle that I believe has been involved in an incident occasioning death/GBH/bodily harm.
As a result I require you to provide a sample of your breath for analysis.

Failure to comply with the requirement is a crime and will make you liable, upon conviction, to a fine of any amount, up to 14 years imprisonment and you bring disqualified from holding or obtaining a driver’s licence for a period of not less than 2 years.

A person under arrest or in custody charged with DUI must be given the following rights
a) To be examined by a medical practitioner nominated by them, if one is available; and
b) to communicate with a legal practitioner and another person nominated by them.
And if they desire to exercise any of those rights, every reasonable facility to do so shall be afforded them.
