What agency has the power to promulgate the IRR of the Labor Code? and How?
DOLE
through their Quasi-Legislative power or Rule Making Power
What is the purpose of IRR when there is already a labor law?
DOLE issues RRs to INTERPRET and IMPLEMENT the law,
Are these RRs considered laws?
They have the FORCE and EFFECT of law provided they do no expand the law or strip the law. Otherwise, under the rules on stat con, these will be considered void.
If the RRs are intended to interpret, they are merely advisory. But if they are intended to implement, then they have the force and effect of laws but they cannot expand and unduly restrict the scope and effect of law.
