A
- In this area of law “GOVERNMENT” can be referred to as “The
Crown”, “The Queen”, the “State”, “Public Authority”, and/or the
Federal, Provincial or Municipal government of the day. - There are several federal statutes, provincial statutes and/or municipal
by-laws directly applicable to this area of law. - Traditionally, the various laws and enactments have applied the
concept of vicarious liability to government agencies for the tortious
acts of their servants, employees or agents. As well, such laws have
historically attempted to invoke certain immunity from
prosecution or immunity from tort liability in order to protect
government in the every day exercise of governing.
