Reg 74 - The following may encroach into the setback distance required by not more than 2·5 m
porches, verandahs and pergolas that have a maximum height of less than 3·6 m above natural ground level;
eaves, fascia and gutters;
sunblinds and shade sails;
permanent and fixed screens referred to in regulation 84(5)(d) or 84(6);
decks, steps or landings less than 800 mm in height.
Reg 74A -Building setback for small second dwellings
A small second dwelling must be set back behind the front wall of the existing dwelling on the allotment that is facing the front street.
must not encroach into the setback distance:
porches, verandahs and pergolas that have a maximum height of less than 3·6 m above natural ground level;
eaves, fascia and gutters;
sunblinds and shade sails;
permanent and fixed screens referred to in regulation 84(5)(d) or 84(6);
decks, steps or landings more than 800 mm in height.
Building height - Reg 75
the height of a building on that allotment must not exceed the relevant height specified in that zone or schedule.
If planning does not specify then
10 m if the slope of the natural ground level at any cross section of the site of the building that is wider than 8 m is 2·5° or more; and 9 m in any other case.
Site coverage - Reg 76
Not more than 60%
Disregard - not more than 600 mm of the width of eaves, fascia and gutters; unroofed swimming pools or spas, unroofed terraces, unroofed patios, unroofed decks and pergolas.
Minimum Garden area - Reg 76A
an allotment that has an area equal to or greater than 400 m 2 and less than or equal to 500 m 2 —not less than 25% of the area of the allotment; and
an allotment that has an area greater than 500 m 2 and less than or equal to 650 m 2 —not less than 30% of the area of the allotment; and
an allotment that has an area greater than 650 m 2 —not less than 35% of the area of the allotment.
Permeability - Reg 77
If planning doesn’t apply at least 20% of the area of the allotment must have a permeable surface.
Car parking - Reg 78
2 required car parking spaces—
The first space must be at least 6 m long and 3·5 m wide; and
the second space must be at least 4·9 m long and 2·6 m wide.
A building may project into a car parking space if it is at least 2·1 m above that space.
Side and rear setbacks - Reg 79
3·6 m or less - 1m
More than 3·6 m but not more than 6·9 m - 1 m plus an additional distance calculated at the rate of 300 mm for every metre of height over 3·6 m
More than 6·9 m - 2 m plus an additional distance calculated at the rate of 1 m for every metre of height over 6·9 m
Walls and carports on boundaries - Reg 80
a wall of a building constructed on or within 200 mm of a side or rear boundary of an allotment or A carport within 1m
