What 3 things must be proved for all cases of sexual violation
1- Intentional act involving sexual connection
2- complainant did not consent
3- offender didn’t believe consenting OR did belief but that belief not reasonable
Define sexual connection
Effected by intro into genitalia/anus by a body part of another or object held/manipulated by another
Connection between mouth/tongue of 1 person and another’s genitalia/anus
Continuation of above
How much penetration is required?
Any degree of penetration no matter how slight or fleeting
Genitalia
Reproductive organs including interior and exterior, includes penis/testicles and vagina/vulva or surgically constructed/altered versions
Sec 44 evidence act
No question for sex complainants on sexual conduct with others except for defendant and not on reputation
Sec 87 evidence act
No details can be given about complainants address without permission of judge
Sec 88 evidence act
Sex case - No evidence or question about complainants occupation
