Management of suspect falls into 3 categories that O/C Investigation will prepare strategy for dealing with each
- Identification and profiling.
- Arrest/ termination.
- Interviewing.
What are the main functions of a File Manager?
Est. and maintaining Investigation HQ. Complete synopsis of all documents received. Manage electronic and physical files. Assist preparation of prosecution file. Assist management of trial.
Who is responsible for determining status of persons during investigation (suspect, POI, witness, victim)
O/C Investigations
After an arrest is made O/C Suspects should
- Isolate suspects from each other.
- Ensure suspects advised of rights/BOR Act 1990.
- Juvenile suspect, police obligations under CYPFA 1989.
- Consider search for evidence of suspect, home, vehicle - warrantless or with warrant.
In investigating any alibi O/C Suspects must
- Make enquiries of people other than the persons whose details have been supplied.
- Make enquiries to est. where suspect was at time of offence, who with, what doing.
- Corroborate with forensics and other independent sources.
Setting up Investigation HQ: File Manager and 2IC est. requirements including:
(C) communications (E) equipment (L) location (T) transport (I) ICT requirements (O) Office support staff
What should you do if media arrive at crime scene?
- Move media away from immediate crime scene.
- Make no comment.
- Advise O/C Investigation.
Principles of disclosure
Governing principle of disclosure is relevance.
- All relevant material is discoverable, unless grounds to withhold/delete under Sec.16, 17, 18.
- No obligation to acquire for purposes of satisfying disclosure obligations, material not in police possession or held in recorded form. Sec.15
- Disclosure is an ongoing process and reasons to withhold material continually reassessed.
- Must be auditable and record decisions relating to each document.
- Effective file management systems critical to success.
Initial Action.
On appointment to role, Disclosure Manager must:
- Read Disclosure Manager desk file.
- Access Serious Crime Template.
- Report to 2IC for briefing/tasking and est. what is/is not discoverable.
Explain Sec.10(4) C.D. Act 2008
Disclosure may be supplied in whatever form, including electronically, provided it is readily accessible to the defendant.
What disclosure should be made to the Crown?
- Identical copy of all material disclosed to defence counsel.
- Crown should review an unedited copy of the material.
Explain Chain of Custody
Includes every individual who has had custody of an exhibit, from time it was first discovered, until produced in court. Demonstrates integrity/admissibility of exhibits.
Alternative options during Area Canvass
- media release
- mail drop
- poster campaign
- high profile police presence, e.g.caravan
What can witnesses in court refer to, to refresh their memory?
Statement and transcript.
Alibi Witness under Sec.22 Criminal Disclosure Act 2008
- must only be interviewed at direction of Crown Solicitor,
- make enquiries to est. veracity of alibi.
- make enquiries as directed by Crown Solicitor.
- forward results to Crown Solicitor.
Police responsibilities to witnesses
By maintaining contact likely to become aware of any threats, intimidation and can take appropriate action such as witness protection programme.
O/Suspects
During suspect interview O/C Suspects must ensure:
- interview conducted in accordance with ‘Investigative Interviewing Suspect Guide’
- interview is monitored by supervisor/experienced Det.
- an explanation is sought re. any exhibits found
O/C Suspects
In investigating any alibi O/C Suspects must

Disclosure Manager.
Key responsibilities -Disclosure Manager must:
- all relevant discoverable material disclosed to defence.
- all relevant non-discoverable material ID’d, listed and defence advised.
- continually assess risk to ensure non-discoverable material ID’d and not disclosed.
- continually review to ensure lawful justification to withhold exists.
- ensure robust auditable systems used.
- manage disclosure timeframes.
- correspondence with counsel in 5000 series.
- create NIA record of disclosure
O/C Exhibits
Appreciation
- Evidential value of each exhibit.
- Investigative opportunities provided by each exhibit.
- Further enquiries needed.
O/C Exhibits is responsible for:
- Establishing and maintaining exhibit management systems.
2. Maintaining physical security and continuity of all exhibits including transportation to and production in Court.
Developing a Forensic Strategy allows O/C Exhibits:
- allows O/C Exhibits to develop a forensic strategy in line with direction of investigation.
- must by approved by O/C Investigation and continually reviewed.
What is a Forensic Strategy meeting?
Meetings held to determine which exhibit or forensic examinations are required and the priority of those.
