What are the aims of Sentencing?

A
  • Punishment: retribution, the idea that the criminal
    deserves punishment. There is an element of revenge.
  • Rehabilitation: reforming offenders so they can be
    reintroduced to society, and contribute positively to society again.
  • Reparation: making amends by putting things right
  • Protection of the public: victims, witnesses, general public
  • Deterrence: stop others committing the offence and the
    offender reoffending

Aggravating factors: things that make the offence more
serious or ‘worse’ i.e No remorse or Bad character
Mitigating factors: things that lower the culpability of
the offender, or make it ‘not as bad’ i.e Guilty plea or Cooperation
