Non-Deadly Force
A victim may use non-deadly self-defense ANYTIME THE VICTIM REASONABLY BELIEVES that force is about to be used on him
Deadly Force Majority
A victim may use deadly force in self-defense ANY TIME THE VICTIM REASONABLY BELIEVES deadly force is about to be used on him
Deadly Force Minority
Victim required to retreat if safe to do so.
No duty if: In your home, are a victim of rape/robbery, police have no duty to retreat
Original Aggressor and Self-Defense
To get privilege back if you are original aggressor you must: withdraw AND communicate that withdraw
Exception: If victim’s initial aggression escalates a minor fight into one involving deadly force, and does so without giving aggressor an opportunity ti withdraw, original aggressor may use privilege
Defense of Others
May use if defendant REASONABLY BELIEVES that the person who he assisted would have had the right to use force in his own defense.
Majority: No special relationship required between victim and defendant.
