What is the case of R v Gladstone Williams ?
The defendant genuinely believe the police was attacking the youth - self defence is allowed if a person genuinely believes they need to use force to repel the attack it doesn’t matter if they are mistaken - you can use force to repel an attack on another
What is the case of R v Martin ?
two males had broken into the defendants farm house - this hadn’t been the first time and within norfolk they were known trouble makers - the defendant shot the two burglars once they had left , this meant they were shot in the back - he tried to use his psychiatric conditions as a justifiable reason but this was rejected
What is the case of R v Keane ?
- the defendant had been out drinking for the night in various pubs - he was convicted for GBH as the defence was not allowed - the defendant was the aggressor or had successfully and deliberately provoked the victim
What is the case of A-G Ref No. 2 ?
The defendants shop had been attack and damaged by rioters - due to fear of further attacks the defendant made petrol bombs - the defence of self defence was accepted as they decided it was correct that the defendant could make preparations for self defence.
