What is Section 2?
Getting admitted for mental health assessment, from within hospital.
2 medical professionals and an AHMP have to agree.
How long does Section 2 last?
Up to 28 days
Can you give medication under Section 2?
Yes, with and without consent
What is Section 3?
Extension of Section 2. This section is for treatment, compared to Section 2 which is for assessment.
If someone has a known mental health condition, they can be sectioned under Section 3 immediately since they do not require assessment.
2 health professionals and an AMHP must agree.
How long does Section 3 last?
Up to 6 months
Can you give medication under Section 3?
Yes, with or without consent.
What is Section 4?
One doctor and an AMHP/relative have agreed to detain the patient whilst waiting for a second doctor to arrive and agree to the section.

How long does Section 4 last?
Up to 72 hours
Can you give medication under Section 4?
With consent
However, in special circumstances treatment may be administered without consent.
What is Section 5(2)?
A more senior doctor (anyone who is not an FY1) has decided that the patient needs to be detained for further assessment.
Happens in A+E
How long does Section 5(2) last?
Up to 72 hours
Can you give medication without consent under Section 5(2)?
No
What is Section 136?
Can be given in public areas (GP surgeries don’t count) with suspicion of psychiatric origin
Only police can give this
Detained in a s136 suite for assessment
