Following Inspector authority when serious violence is predicted and it is necessary to prevent such violence, S60 gives a search power in a defined area for up to 24hrs.

A

A

Power of entry to a controlled or occupied premises by a suspect who has been arrested for an Indicatable offence (Either way or Indicatable). Authorised by the rank of inspector and above. Search for evidence relating to the offence, a similar offence or a related indictable offence.

S.18 (5) - ‘Keeping it alive’ - Can enter a premises and search it prior to inspectors approval if you believe that evidence could be lost if action isn’t completed quickly.

A

A constable may seize anything, when lawfully on a premises, in which he has reasonable grounds for believing it to be evidence in relation to an offence he is investigating.

What is the definition of S23(2) Misuse of Drugs act 1971?

A

If a constable has reasonably grounds to suspect that a person is in possession of a controlled drug in contravention of the Act, the constable may -

  • search that person and detain him.
  • search any vehicle or vessel in which there is suspicion a drug may be found.
  • seize or detain anything found in the course of the search which appears to be evidence of an offence.

What are the six types of resistance?

A

Compliance - The person offers no resistance and complies with requests. It is important that officers understand that this could change rapidly

Verbal resistance and gestures - The person refuses to comply either verbally or, by their body language, non-verbally

Passive resistance - The person stands/sits/lies still and will not move

Active resistance - The person pulls away or pushes the officer but makes no attempt to strike them

Aggressive resistance - The person physically attacks the officer

Serious or aggravated resistance - The person commits an assault which presents the possibility of serious injury or death. This includes the use of weapons
