i. Cassias v. State
A
defendant was arrested for Poss. Cocaine pursuant to a search warrant. Defendant files a motion to suppress alleging the affidavit in support of the SW lacked PC. The affidavit didn’t mention the address to be searched not did it mention the address as the location described in the surveillance activity. The items described as being purchased for production are not specified as to why the officer believes that way. The court holds that the affidavit described acts that could be viewed as innocent acts so it was insufficient. As a result, the evidence against the defendant was suppressed.
